Family law typically covers divorce, custody and access, child support, and division of property.
Divorce
Divorce is the dissolution of a marriage. It is the legal process by which a marriage can be terminated. Marriage may be ended by mutual consent, by order of the court after a suit for divorce has been filed, or by the death or disability of one spouse. Divorce can be done unilaterally or bilaterally. Divorce is not necessarily an emotional process.
Custody
Custody is the right of a parent to care for and control, health, and welfare of a child. The parent must be able to prove they are responsible for the child in order to gain custody. Child custody cases can be very complicated, especially when parents are separated. There are many different factors that go into making a decision. But one of the most significant factors is the contact limitation.
Child Support
This is a system of financial support paid by one parent to the other for the maintenance of a child who is the subject of a divorce or other family law proceeding.
The purpose of child support is to provide for the care and support of a child, including food, clothing, shelter, education, and medical expenses. Child support usually terminates when the child turns 18 years old.
The amount of child support is based on the gross income of both parents and can be paid in one of three ways: monthly, semi-monthly, or quarterly.
Division of Property
Divorcees must discuss and reach an agreement about the division of their mutual properties in the presence of legal representatives. These will include every item, property, debt, and financing that requires the approval of both parties.
